ONE: This ticket is issued to the named
traveller. It is non-transferable
and its use by a person other than the named traveller holder shall result in
penalties provided by the law.
TWO: The named traveller, and their
personal luggage (up to 20kg per person), is entitled to carriage by the company
for the journey shown on the ticket. The luggage shall be carried in the
sections of the vessel indicated by the company. The company does not accept any
responsibility for the carriage of valuable objects. The carriage of objects for
illicit trade is prohibited, as per the description of items and/or goods listed
as dangerous in the I.M.D.G. Code.
THREE: The named traveller is protected by
Obligatory Travellers Insurance throughout the carriage. The passenger must
behave in accordance with safety and police regulations as well as general
regulations such as those onboard the ship. The company is not liable for the
consequences of passenger carelessness or failure to comply with the indicated
regulations.
FOUR: On board food and beverage items
are not included in the price of the ticket.
FIVE: The carrier undertakes to do
everything possible to carry the passenger and luggage with reasonable
diligence. The times shown on the schedules and elsewhere are not guaranteed and
do not form part of the contract. If necessary, the Company may replace the ship
assigned to that journey and/or vary both the schedule and travel dates. In this
instance the passenger shall only be entitled to either a refund of the price,
or a new reservation for the first or subsequent date or time with seat
availability, at the passenger’s choice.
SIX: This ticket is valid for one year
as from the date of issue unless otherwise stated on the ticket. Should the ticket not be used on the
date for which it was booked and on the specific journey for which it was
issued, the named traveller may still use this ticket by requesting a new
reservation and paying any difference in fares that may occur. The costs of the
reservation amendments shall be specified by the carrier and may be up to 25% of
the ticket price. If the named traveller decides not to use the ticket before
the validity expires after cancelling the reservation, they shall be entitled to
a refund of 75% of its price. If the ticket has been issued by a Travel Agency,
the refund application must be addressed to this
Agency.
SEVEN: No claims shall be accepted if they
are not accompanied by the ticket receipt. Moreover, any claim must be
formalized in writing and presented on the ship or in the company’s offices
during or at the end of the journey.
EIGHT: The company is only liable up to
the maximum sum per item specified in the maritime regulations in the unlikely
event of any damage caused to luggage or vehicles. In the case of luggage
carried inside a vehicle, the entire luggage is considered as one item. The
operations of vehicle embarkation and disembarkation covered by this ticket are
carried out by the owners of the vehicles or their representatives and the
carrier is not liable for any damage caused during these operations, except when
they result from the negligence of the carrier or its
employees.
NINE: The passenger must arrive at the
port with enough time to obtain the corresponding boarding cards, before the
time limits indicated by the carrier. Once the time limit has passed, the
carrier has no liability for not allowing the passenger and/or the vehicle to
embark.
TEN: The carriage of both passenger
(private) vehicles as well as freight vehicles shall be subject to company
regulations, copies of which are available to passengers in the Sea Terminals.
The transport of dangerous goods without the carrier’s explicit permission is
strictly forbidden.
ELEVEN: No agent, employee or
representative of the carrier shall have authority to alter, modify or renounce
any of the provisions laid down in this
contract.
TWELVE: a) Confirmation
of departure on an OPEN ticket will not give rise to a refund. b) Tickets issued
with promotional prices or on offer will be subject to specific conditions that
should be consulted for each offer. c) Savings Packs are based on a specific
number of passengers and are therefore indivisible. If a place is not occupied,
this will not give rise to a refund and this place may not be used on a future
sailing. d) As a general rule, boarding cards are only valid for the journey
for which they have been isssued and, in the case of not being used, they will
be annulled and no refund will be given.
